These Terms of Service ("Terms") govern your access to and use of the website istary.io (the "Site"), owned and operated by Istary OÜ ("Istary", "we", "us", or "our"), a company registered in Estonia. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Istary regarding your use of the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site. We reserve the right to modify these Terms at any time. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

6. Disclaimer and Warranties

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED ON THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ISTARY OÜ EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

ISTARY OÜ MAKES NO WARRANTY THAT (A) THE SITE WILL MEET YOUR REQUIREMENTS; (B) THE SITE WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.

7. Limitation of Liability

IN NO EVENT SHALL ISTARY OÜ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (C) ANY CONTENT OBTAINED FROM THE SITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ISTARY OÜ FOR ALL CLAIMS RELATING TO THE SITE EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU HAVE PAID TO ISTARY OÜ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Unsolicited Ideas

Istary OÜ does not accept or consider unsolicited ideas, including ideas for new products, technologies, promotions, product names, or processes. If you send us any unsolicited ideas, suggestions, materials, or other communications ("Submissions"), regardless of any accompanying statements, you agree that such Submissions are not confidential and that Istary OÜ shall have no obligation of any kind with respect to such Submissions. Istary OÜ shall be free to use, reproduce, distribute, and otherwise exploit any Submissions for any purpose without acknowledgment or compensation to you.

9. Miscellaneous

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure by Istary OÜ to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Right to Restrict Access

Istary OÜ reserves the right, in its sole discretion, to restrict, suspend, or terminate your access to the Site at any time, without notice and for any reason, including but not limited to a breach of these Terms.
